Until laws are enacted that specifically prohibit verbal bullying, an employee who is subjected to a bully may have few legal options. As with any workplace issue, the first thing is to report the problem to the human resources department. A real effort should be made to tie the bullying to one of the bases of discrimination.
The employee who is being bullied must make the employer see that allowing the bullying to continue will affect the bottom line, either through litigation or the loss of productivity. Right now, though, that may be a losing battle. Because the issue of bullying in the workplace is changing, an employee who is subjected to bullying should contact a local employment attorney before making any drastic moves.
