The EEOC takes very, very few cases into court. Just because the EEOC will not represent you in court, though, does not negatively reflect on the merits of your particular case. The EEOC is continually being bombarded with discrimination complaints that need to be processed.
As the economy continues to have problems, employers are allowed to send jobs offshore, and stockholders demand that expenses be cut, the complaints to the EEOC continue to rise. The EEOC continues to work at the maximum level with little, if any, additional government funding for all the extra cases it needs to consider.
